Supporting consumers in arrears
Ayvens understands that any customer could find themselves in arrears at some point in their contract with us. If that happens, we are here to support you.
In dealing with Consumers who are in, or at risk of entering arrears, Ayvens applies the following principles:
- 1.Our communication with the customer will be prompt and direct and clearly outline the situation in a way they can understand
- 2.We will be fair and accommodating with the customer
- 3.We will seek to support the customer in resolving the arrears situation by proposing and being receptive to reasonable and achievable remedies that aim to restore their account to good standing
- 4.We will treat termination of an agreement as a last resort to be avoided if reasonably possible
- 5.We will seek to resolve invoicing disputes quickly and fairly
- 6.We will at all times act in accordance with the relevant legal requirements
If you are unable to make any payment due to Ayvens on or before the due date, you should contact us on 01 246 1950 / personal.ie@ayvens.com as early as possible, so that we can discuss your circumstances and agree supports for you if appropriate. If you would prefer that we deal with a third party on your behalf, please write to us with details of your nominated party and we will be happy to do so.
If you find yourself facing financial difficulty, Ayvens recommends consulting MABS. MABS is a service that is available free of charge to help people with financial management, budgeting and managing debts. Visit MABS The Money Advice and Budgeting Service.
Consequences of failing to address arrears
The most important step to dealing with arrears is engaging with Ayvens. Failure to engage means we are unable to consider possible supports to assist you. If arrears persist and are not addressed, you risk the following:
Repossession of the vehicle and termination of the contract
Early termination fees of 50% of the outstanding lease rentals from the point of termination, in addition to the unpaid amounts
Liability for costs associated with the repossession of the vehicle
Legal action to recover unpaid amounts, and the costs associated with Ayvens bringing any legal action. Legal action may also result in a charge over your property, and difficulty in selling your property in the future
It is Ayvens’ desire to avoid these consequences wherever possible. By engaging with us, we can work with you to find appropriate supports.
All queries relating to arrears cases should be directed to 01 246 1950 / personal.ie@ayvens.com.
